Welcome to Tutorlii. By using our website and services, you agree to be bound by the following Terms of Agreement. Please read them carefully before accessing or using our services.

1. Acceptance of Terms

By registering for or using Tutorlii’s services, you agree to comply with and be legally bound by these Terms of Agreement, whether or not you become a registered user of the services. If you do not agree to these terms, you should not use our services.

2. Services Provided

Tutorlii provides a platform that facilitates the booking and scheduling of tutoring sessions, processes payments, and matches students with highly qualified tutors. Tutorlii acts as an intermediary between students and tutors and does not provide tutoring services directly.

3. User Responsibilities

Users of Tutorlii agree to:

  • Provide accurate and complete information when registering and updating their accounts.
  • Use the platform solely for its intended purpose and in compliance with all applicable laws, including the Education Act and Consumer Protection Act of Ontario.
  • Engage with tutors and arrange work solely through the Tutorlii platform and not request or offer to handle payments outside of the platform.
  • Respect the rights and privacy of other users and not engage in any conduct that is harmful, deceptive, or illegal.

4. Payment and Booking

Users are required to pay for tutoring services through the Tutorlii platform. Payments are processed securely and must be made prior to the scheduling of sessions. By booking a session, you agree to the fees associated with that session as outlined on our website.

Tutorlii is not responsible for any errors or omissions in the payment process. It is the user’s responsibility to ensure that payment information is accurate and up-to-date.

4.1 Payment Protocol

All interactions, scheduling, and payments must be conducted exclusively through the Tutorlii platform. Clients are strictly prohibited from arranging sessions, discussing fees, or making payments directly to the Tutorlii tutor outside of the Tutorlii platform. Any attempt to bypass this process is a violation of these Terms and may result in the immediate termination of services without refund.

This policy ensures that all transactions are transparent, secure, and compliant with legal and regulatory standards. By agreeing to these Terms, you acknowledge that any arrangements for tutoring services outside of the Tutorlii platform with Tutorlii tutors are unauthorized and release Tutorlii from any liability arising from such unauthorized arrangements.

5. Cancellation and Rescheduling

  • Individual Sessions: Cancellations of individual tutoring sessions must be made at least 24 hours before the session’s start time to receive a full refund.
  • Package Sessions: Sessions that are part of a package may be rescheduled with at least 24 business hours’ notice but are not eligible for refunds.

Tutorlii reserves the right to cancel or reschedule sessions at its discretion. In such cases, users will be offered an opportunity to reschedule without penalty.

6. Tutor Matching Process

Tutorlii is committed to providing highly qualified tutors who are Ontario Certified Teachers (OCT) and have undergone vulnerable sector checks. We use our expertise to match students with tutors who best meet their educational needs and preferences.

While Tutorlii makes every effort to ensure a successful match, we do not guarantee the suitability or availability of any tutor. Should any issues arise, users are encouraged to communicate with Tutorlii to resolve the matter.

7. Intellectual Property

All content and materials available on the Tutorlii platform, including but not limited to text, graphics, logos, and software, are the property of Tutorlii or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Users may not use, reproduce, distribute, or create derivative works from the content on the Tutorlii website without express written permission from Tutorlii.

8. Limitation of Liability: Damages

To the fullest extent permitted by law, Tutorlii and its affiliates, founders, officers, directors, successors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill, arising from or related to the use of our services.

Tutorlii does not guarantee the accuracy, completeness, or timeliness of information provided on the platform and is not liable for any errors or omissions.

9. Limitation of Liability: Outcomes

Tutorlii strives to match clients with tutors who meet their educational needs and goals. However, we do not guarantee specific outcomes. Tutorlii is not liable for any damages or losses arising from the use of our services, including but not limited to dissatisfaction with the tutor’s performance or the educational progress of the student.

In no event shall Tutorlii, its affiliates, or any of their respective founders, officers, directors, successors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the services provided, even if advised of the possibility of such damages.

10. Governing Law and Jurisdiction

These Terms of Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising out of or in connection with these terms shall be resolved in the courts of Ontario.

11. Conflict of Interest

Students and families agree not to hire or solicit tutoring services from any Tutorlii tutor who is employed as a teacher at the student’s home school. Any such arrangement outside of Tutorlii will result in immediate termination of services.

If I am registering a student who is currently a student with the Toronto District School Board (TDSB), I confirm that I independently sought out and initiated contact with Tutorlii for tutoring support for my child.

If I am a TDSB student aged 18 or older, I confirm that I independently sought out and initiated contact with Tutorlii for their services.

12. Modifications to Terms

Tutorlii reserves the right to modify these Terms of Agreement at any time. Changes will be effective immediately upon posting on our website. Continued use of the platform following any changes constitutes acceptance of the revised terms.

13. Termination

Tutorlii reserves the right to terminate or suspend access to our services, with or without notice, for any violation of these terms or for any other reason at our sole discretion, as permitted by applicable law.

14. Privacy and Data Protection

Tutorlii complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and is committed to protecting the privacy of our clients and tutors. Any personal information collected will be used solely for the purposes of providing tutoring services and will not be shared with third parties without your consent.

We take reasonable measures to safeguard your personal information against unauthorized access, use, or disclosure. However, we cannot guarantee the absolute security of your data. By using our services, you acknowledge and agree to our collection, use, and disclosure of your personal information as described in this policy.

Tutorlii is committed to protecting your privacy and ensuring that your personal information is handled in a safe and responsible manner. Our privacy practices comply with applicable privacy laws.

15. Dispute Resolution

Any disputes arising under these Terms of Agreement shall be first addressed through good-faith negotiation between the parties. If a resolution cannot be reached, the dispute shall be submitted to arbitration in accordance with the Arbitration Act of Ontario.

Client acknowledges and agrees that Tutorlii, its founders, directors, officers, agents, successors, and employees will not be personally liable for any breach by a client or Tutorlii tutor of any violations of the Ontario College of Teachers’ Code of Conduct, TDSB policies, Education Act, collective agreement, or any other policies, practices, directions, and instructions by any regulatory body governing teachers, as applicable.
